Special Conditions of Use of Community Space
These Special Conditions of Use (hereinafter, "the CPUs") describe and organize the conditions under which the Visitor or the Producer can use particular functionalities relating to the services accessible on the site www.localementbon.fr, within the framework from the "JOIN THE COMMUNITY" service.
The CPUs, intended only for Visitors who have created a Member Account (hereinafter, "the Member"), thus supplement the General Conditions of Use (hereinafter, "the T & Cs") which set the general rules for use of the site www.localementbon.fr for the attention of all internet users.
The Member therefore expressly and unreservedly undertakes to comply with both these FPS and the T & Cs (Link) during each of his visits to one of the Community Spaces, whatever the nature of his intervention. For this reason, the Member is invited to read very carefully both the T & Cs and the CPUs.
ARTICLE 1 - DEFINITIONSCommunity space: refers to all of the spaces on the Site accessible to Visitors who have created a Member Account (as part of a free registration or a purchase act) and on which they can deposit their Contributions, chat or use different features with the Members community.
Access codes: designate the identifier and password allowing the Member to identify himself and connect to the Site, in order to access his Account. These username and password are chosen and communicated to the Site by the Member when opening their Account.
My Account: means the Personal Space of the Site to which the Member can only have access after registering, by filling in their Profile and which allows them to access the Community Space; the creation of this Account is also essential to place orders online.
Contribution: means any information, in any form whatsoever (texts, photographs, images, videos, audiovisual combinations, files, photographic or videographic recordings, data, hypertext links, etc.) posted by the Member in the Community Space ( Favorites, Chat, news feed, routes, push notifications).
(The) Parties: means all of the protagonists of the contract for the marketing of paid and free products and Services offered by the Site, i.e. the Client and LOCALEMENT BON; each of these protagonists can be individually designated as a "PARTY".
Profile: designates the information communicated by the Member during his registration and the opening of his Account (username and Access codes).
Site: means the LOCALEMENT BON website accessible at www.localementbon.fr.
ARTICLE 2 - PRESENTATION OF THE COMMUNITY SPACE2.1 The Site offers Members a "REGISTERED" service which allows them to create an Account to participate in the Community Space and, in particular, deposit Contributions and exchange with other Members in the context of dialog spaces or various other features, including comments, suggestions and discussions via chat or forum. The Community of Members participates as such in the development, the richness and the diversity of the Site. The quality of its interventions and Contributions is a guarantee of the Site's success and reputation.
Any Site Visitor wishing to purchase paid services offered by the Site must also create an Account, if they do not already have one.
The Community Space is freely accessible to any Member, subject to registration and full compliance with the T & Cs and these CPUs. The duly created Account authorizes access to all of the Community Space services.
To create an Account and complete a Profile, minor children must obtain the prior authorization of their parents or the adult benefiting from parental authority. The latter are therefore invited to ensure that minor children cannot fill in the online forms containing personal data, or that they can only fill them out under their supervision.
2.2 The Member is informed that LOCALEMENT BON reserves the right to carry out, without notice and without compensation, the maintenance operations necessary for the proper functioning of the Community Space, in order to make the modifications and improvements required by technical developments or continuity of services. These maintenance operations may, if necessary, be the cause of a temporary suspension of access to the Site. LOCALEMENT BON also retains the possibility of developing the Community Space as it sees fit.
The Member is informed of the right that LOCALEMENT BON retains, without compensation, to put a temporary or permanent end to the Community Space and / or to the Site. In this case, he will be notified within a reasonable time of this closure by a notification disseminated via the Site.
2.3 In return for the free nature of the services offered by the Site (Community space, etc.), the Member expressly accepts that the Contributions that they voluntarily put online are associated with promotional advertising messages of any type (texts, videos, sounds, etc.). .).
The attention of the Member is more particularly drawn to the fact that his Contribution to the Site is carried out free of charge and that he cannot claim any remuneration or remuneration on account of the income possibly generated by the dissemination of these advertisements.
ARTICLE 3 - REGISTRATION AND TERMINATION TERMS3.1 Participation in the Community Space is reserved for Visitors with an Account. The creation of the Profile notably requires the communication of the following information:
Choice of a user name: the Visitor undertakes not to choose a pseudonym which could infringe the rights of third parties, in particular their surname or their brand;Last name First Name ;Email: the communication of a valid address being necessary for the activation of the Profile, any invalid email will lead to the deletion of the Profile;Password: for security reasons, it is recommended to choose a password that is sufficiently complex to thwart fraud;Photograph (optional): by adding a photograph to his Profile, the Visitor confirms his agreement so that it is disseminated in association with his pseudonym and can therefore be visible to other members of the community; the Visitor undertakes not to choose a photograph infringing the rights of third parties;Postal coordinates (optional).Online contact details / website (optional).Availability and price of products (optional).Telephone coordinates (optional): by transmitting his telephone coordinates, the Visitor confirms his agreement for them to be used by the Site in order to contact him.The only element visible on the Community Space by other members (possibly with a profile photograph), the pseudonym identifies the Member while preserving his anonymity. It is specified that the other information entered during registration is only accessible to the administrator of the Community space.
The Member can modify and update at any time the information communicated within the framework of his registration, from his Account by clicking on the My Profile section.
The attention of the Member is drawn to the obligation which weighs on him to communicate complete, exact and up-to-date information, under penalty of the sanctions provided for in Article 6.4.
3.2 Registration also requires the following details, by ticking the box provided if necessary:
"I agree to receive by email offers from Localement Bon partners".Finally, the Visitor must select the box "I have read and I accept the General Conditions of Use and the Special Conditions of Use of the Academy of Taste." and click on "Validate".The attention of the Visitor is drawn to the fact that the registration and the creation of an Account imply acceptance of receiving the newsletter of the Site (when the functionality will be available), a right of opposition remaining to him open under the conditions provided for in Article 8.3 of these CPUs.
Once their registration has been confirmed, the Visitor receives an email from the Site confirming their Registration to the email address they have entered.
The Member is invited to keep this confirmation email for his records. The Member’s attention is drawn to the fact that this email could arrive among the spam of his mailbox and that the responsibility of the Site could not be engaged in this regard. 3.3 The Member has the possibility of completing and personalizing his Profile at any time by adding Contributions (photographs, notifications, products and others, favorite addresses, links to his social networks etc.). These elements of the Profile can therefore be freely consulted by other Members of the Community Space.
3.4 The Member has the option at any time to close his account by sending an email to firstname.lastname@example.org. Contributions and comments made before deleting the Account will then be made anonymous.
ARTICLE 4 - MANAGEMENT OF COMMUNITY SPACE4.1 It is expressly reminded that, within the framework of the Community Space, LOCALEMENT BON intervenes exclusively as a content host within the meaning of article 6-I-2 of Law n ° 2004-575 of June 21, 2004 for confidence in the digital economy. As such, it is not bound to any general obligation to monitor Contributions submitted and / or disseminated within the framework of the Community Space, nor to any obligation of guarantee as to the accuracy, probity and honesty of information thus put online.
The Site does not endorse any content. It can in no way be held responsible for Contributions posted by Members, subject to having been previously informed (Article 4.3). In the event that LOCALEMENT BON is the subject of legal action due to the Contribution of a Member, it reserves the right to call it as a guarantee.
4.2 The Community space of the Site is subject to a posteriori moderation. Each Member thus has the possibility of directly publishing his Contribution, without prior control by LOCALEMENT BON and therefore under his sole responsibility.
Contributions thus put online can be checked by a moderator. The role of this moderator consists in ensuring an optimal development of the Contributions, an editorial coherence, as well as a homogeneity of the editorial line of the Site. To this end, modifications may be made to Contributions (typography, syntax, spelling error, photography, etc.). For example, the title of a producer may be modified, so as to distinguish it from other Contributions with the same designation.
In case of refusal of the modifications made by the moderator, the Member retains the possibility of unpublishing his Contribution.
The moderator also ensures compliance with the Laws and Regulations. It proceeds in particular to the outright deletion, at any time and without notice, of any Contribution all or part of the content of which is likely to constitute an apology for crimes against humanity, incitement to racial hatred as well as child pornography and other offenses referred to in Article 6.2 of these CPUs, or to infringe the rights of third parties (Article 7). The moderator can also delete content outright at the request of a judicial authority.
There is no automatic right of the Member to have his Contribution posted. The fact that a Contribution is subject to a depublication measure does not give rise to any compensation of any kind for the benefit of the Member.
4.3 Any Member having knowledge of words and / or content contrary to the Laws and Regulations in force and / or infringing the rights of third parties (intellectual property rights, personality rights etc.) is invited to notify the Site as soon as possible deadlines, to the following address: email@example.com. This Link is notably accessible on all pages containing content offered by "REGISTERED" or "SUBSCRIBED" Members.
In accordance with the provisions of Law No. 2004-575 of June 21, 2004 on confidence in the digital economy, LOCALEMENT BON undertakes to act promptly to withdraw this data or make access to it impossible, as a precaution, as of when he becomes aware of it.
The Member is informed that the fact, for any person, of presenting a content or an activity as being illicit in order to obtain its withdrawal or to stop its dissemination, even though he knows this information is inaccurate, is punishable by one year imprisonment and a fine of 15,000 euros.
In accordance with article 6.IV of Law n ° 2004-575 of June 21, 2004, any person appointed or designated in an online public communication service has a right of reply (in the form of a written ), without prejudice to requests to correct or delete the message it may send to the service. ARTICLE 5 - "LOCALEMENT BON" LABELI n order to encourage the posting of recipes and to reward the quality of the Culinary Contributions of its Members, the Site reserves the possibility of assigning a "LOCALEMENT BON" label to those which it considers to be of interest in terms of content, technique, artistic or other particular, justifying their development on the site.
The attribution of the label, intended to enhance unique recipes by their content and quality, is decided by the editorial team of the Site. Only Contributions that comply with the editorial and editorial requirements of the Site can benefit from this label.
The Member's attention is particularly drawn to the fact that there is no automatic right to benefit from the "ACADEMIE DU GOUT" label.
ARTICLE 6 - OBLIGATIONS AND RESPONSIBILITY OF MEMBERS6.1 The Member undertakes not to engage in any form of commerce within and / or through its Contributions, including in the form of diverted advertising.
6.2 The Member assumes full responsibility for the Contributions that he edits and publishes within the Community Space. The question of intellectual property rights and the rights of third parties is specifically dealt with in Article 7 of these CPU.
The Member undertakes that the content of his Contributions complies with French law. Without this list being exhaustive, he undertakes in particular that his Contributions comply with public order and morality; cannot offend the sensitivity of minors; do not infringe the privacy of third parties; do not affect the presumption of innocence of persons or the respect and authority due to justice; do not contain disparaging, defamatory, offensive, humiliating or offensive words or images; are not pornographic or pedophile; do not offer the sale, donation or exchange of stolen or fraudulent property, fraud, breach of trust or any other criminal offense; do not incite hatred, violence, suicide, racism, anti-Semitism, xenophobia, homophobia; do not condone war crimes or crimes against humanity; do not incite discrimination against a person or a group of people on the grounds, in particular, of their political opinions, their ethnicity, religion, or because of their sexual orientation. Persecution, threats and harassment are also not tolerated.
The Member undertakes not to include in his Contributions addresses or hypertext links to external sites which are contrary to French law, in particular for one of the offenses mentioned in the previous paragraph. The Site also reserves the right to proceed without prior notification of any comment and / or hypertext link that is irrelevant because it is not related to the purpose of the Site (advertising links in particular).
6.3 The Member undertakes not to make any comments in the Community Space directly or indirectly damaging the Site and / or LOCALEMENT BON and / or their reputation.
6.4 Without prejudice to any damages it may request, the Site expressly reserves the possibility (without being an obligation) to exclude, temporarily or definitively, any Member in the event of repeated non-compliance of the commitments made in Articles 6.1, 6.2 and 6.3 of these CPUs and / or repeated violation of the rights of third parties (intellectual property rights, personality rights etc.) recalled in Article 7 of these CPUs. In general, the repeated violation of the provisions of the T & Cs and these CPUs is a cause for temporary or permanent exclusion. The Site therefore reserves the right to terminate the Member Profile.
6.5 It is recalled that the password and the Access Codes are strictly personal information. The Member is responsible for their management, their conservation and their consequences. He therefore refrains from disclosing them in any form whatsoever to third parties and is informed that their communication is made under his sole responsibility.
Any connection to a Member's Account is presumed to have been made by that Member. The Member is responsible for all the financial consequences resulting from the use of the Site on his behalf, including by third parties, even minors, except to demonstrate fraudulent use not resulting from any fault or negligence on his part. The Member is therefore invited to log out at the end of each session. The Site can in no way be held responsible for any fraudulent use committed through these Access Codes.
In the event of theft, loss and / or accidental disclosure of their Access Codes or even fraudulent use of their Account, the Member undertakes to inform the Site as soon as possible at the following address: firstname.lastname@example.org. LOCALEMENT BON will then cancel these codes to allow them to be reset by the Member.

ARTICLE 7 - INTELLECTUAL PROPERTY AND THIRD PARTY RIGHTS7.1 It is recalled that the Contributions of the Members are posted online in the Community Space where they are freely consultable, without prior authorization, by any Visitor, whether registered, subscribed or simple consultant.
The Member grants free of charge to LOCALEMENT BON, for the world, the right to reproduce, represent, publish, distribute and produce derivative works, under the pseudonym he has chosen, by all current electronic and digital means and processes, or future, in any medium and in any format, in whole or in part, each of the Contributions that it has posted online in the Community Space of the Site. This assignment is valid for the duration of the protection of intellectual property rights according to both French and foreign legislation and current or future international conventions.
7.2 The Member expressly guarantees that the content of the Contributions that he puts online on the Site belongs to him, is free of rights or that he has obtained the necessary authorizations for putting it online in compliance with the T & Cs and CPUs. In particular, it guarantees that it holds all intellectual property rights (copyright, trademarks, etc.) in texts, photographs, images, videos, audiovisual combinations, files, photographic or videographic recordings, data and other than it broadcasts in the Community Space and that its Contributions do not infringe the intellectual property rights of third parties.
In general, the Member guarantees that the Contributions (texts, photographs, images, videos, audiovisual combinations, files, photographic or videographic recordings, data and others) that he disseminates in the Community Space do not infringe the rights of third parties. , including the right to image and the right to respect for private life.
7.3 The Member is solely responsible for the Contributions which he puts online and is therefore liable for any damage, direct or indirect, which they may cause LOCALEMENT BON and / or to third parties. The Member undertakes to make his own business of any claim, any claim, any recourse and, more generally, any procedure (legal or other) brought by a third party against LOCALEMENT BON due to the infringement which would have been brought to the rights of third parties because of its Contributions to the Community Space, whether it be intellectual property rights (copyright, trademark right etc.), an attack on life private, an infringement of the image right or other.
The Member undertakes to inform the Site without delay of any complaint, any claim and any remedy and, more generally, of any procedure (legal or other) which would target him because of his Contributions posted online in the Space community.
ARTICLE 8 - DATA CONFIDENTIALITY POLICY AND COOKIES8.1 LOCALEMENT BON has implemented a policy for the protection of privacy and information communicated by Site Visitors, in compliance with Law n ° 78-17 of January 6, 1978 (amended) relating to data processing, files and freedoms. Thus, the collection and processing of the member's personal data has been declared to the CNIL under the declaration receipt n ° 1770330

ARTICLE 10 - APPLICABLE LAW AND COMPETENT JURISDICTIONSThese CPUs are written in French, the single language of the Parties. Any translation possibly provided would only be for the convenience of the Member, only the French version being authentic.
These CPUs are subject to French law only.
In the event of a dispute, the Parties seek an amicable solution in good faith before any legal action. The Member is informed of the possibility of resorting to a conventional mediation procedure or to any other alternative method of dispute resolution.
In the event of failure, any litigation relating to these CPUs, their interpretation, their validity and their consequences, whatever the location of the Parties, is subject to the exclusive jurisdiction of the Courts of Paris, including in the event of plurality defendants or third parties.
